POPOVER GAMES, INC. (“us,” “we,” or “Popover”) is committed to respecting the privacy rights of its users ("users" or "you"). Popover created this Privacy Policy (this “Policy”) to give you confidence as you visit Popover.com ( the "Site") and play Popover games or use our applications ("Service") , and to demonstrate our commitment to fair information practices and the protection of privacy. This Policy is only applicable to the Site and to our Services, and not to any other websites that you may be able to access from the Site or through our Service, each of which may have data collection and use practices and policies that differ materially from this Policy.
By using our Service, you agree to the terms of this Policy. Popover may make changes to this Policy from time to time. Our goal in collecting information is to enhance our Services and to increase the use and enjoyment of our Services by our users.
WHAT INFORMATION DOES POPOVER COLLECT?
In operating the Site and the Service, Popover may include registration, online surveys, and other online forms that ask users to provide their names, e-mail addresses, and other contact information that can be used to contact or identify you ("Personal Information"). Popover may also collect information about you and your preferences that cannot be used to identify you personally, such as your birthday or personal preferences ("Non-Personal Information"). Together, your Personal Information and Non-Personal Information shall be known as "Information" for the purposes of this Policy. The exact nature of the information will vary depending on the activity. Popover collects Information in two ways: 1) from you directly and 2) from third party social networks and/or mobile devices.
INFORMATION FROM YOU
When you register with Popover, your profile as well as any information you provide during the registration process and use of the Service, will be collected by Popover. Popover will collect Information that you submit. In addition to Personal Information, Popover will also collect Non-Personal Information directly from you as well. Non-Personal Information may include information about your use of the Service, achievements earned, use of virtual currency provided by Popover as well any other information about the type of hardware you use to access the service. It may also include your gender, age and date of birth. If you submit information about other people, for example, buying a virtual good as a gift for another user, Popover will collect that information as well, including the recipients' name and identifying information that you provide.
Popover may also collect aggregate data collected from you and other users. For certain Services, we may collect technical information about your computer or mobile device and usage data and statistics as well as web logs that maintain records of actions taken on our Service by our users. If you communicate with other users or Popover on our Service, we may record and store a record of those communications to protect the safety of our users. By using our Service, you consent to the recording of all communications that you may make while using our Service, whether those communications are made to other uses or to Popover directly through message boards or support emails. Actions between you and other users may also be recorded, including the identity of users you have searched for or who have searched for you. Popover collects information about your game play on the Service. Some of the information we collect will be shared with other players through your user profile, including information regarding achievements earned, game stakes played, your friends on the Service, date of sign up with the Service, win/loss record and items purchased for yourself and for others. As part of your player profile, Popover may share your photo as part of your profile picture which may be obtained from a TPN or from you directly.
INFORMATION FROM SOCIAL NETWORKS AND MOBILE DEVICES
Some users may access the Service through a social network such as Facebook or a mobile device such as an iPad (collectively, "Third Party Network" or "TPN"). By accessing the Service through a TPN, you give Popover permission to access, store, collect and use any and all information that you agreed may be shared and used with Popover by the TPN. The information provided to us by TPN is based on your privacy settings with the TPN or through your consent between the TPN and you. By accepting to use our Service through a TPN, you agree that the TPN may share information about you with Popover and that Popover may use that information as described in this Policy. If you access our Service from your mobile device(s), we may collect your unique device identifier, phone number, and other information provided to us from the TPN unique to mobile devices.
AUTOMATIC COLLECTION OF INFORMATION
Our servers automatically recognize visitors’ domain names and IP addresses (the number assigned to computers on the Internet). No personal information about you is revealed in this process. The Site may also gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to our Site. We do not set any personally identifiable information in cookies, nor do we employ any data capture mechanisms on our Site other than cookies. POPOVER'S USE OF INFORMATION
Popover uses Information to enhance your experience while using our Service and to comply with your requests and actions taken while using the Site or Service. The Information you provide will also permit us to communicate with you about account specific information as well as send you information about your game play, purchases, new products and features, upgrades, contests, competitions and special offers. We may also use information to resolve technical problems and to better understand the preferences and choices of our users. We may also use Information to share your achievements with other users or members of the TPN on your profile page or news feed applicable to the specific TPN. We may also use your information to enable and enhance user to user communication, prevent fraud, enforce our Terms of Service or to comply with the requests of law enforcement.
SERVICE PROVIDERS
Popover uses third party service providers to facilitate purchases and payments as well provide certain Services. Popover does not use or store your credit card information; rather, we use third party credit card or mobile payment service providers. We may use Information about your method of payment option to better understand which payment methods our users prefer. The Site or Service may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.
SECURITY
The Site and Service has reasonable security measures in place to prevent the loss, misuse, and alteration of Information. We cannot guarantee that unauthorized access to your Information will never take place or that unauthorized third parties will never be able to overcome our security measures and use your Information for improper purposes. USER AGE LIMIT
Our Site and Service is intended for use by those over the age 18 for entertainment and amusement purposes only. We recommend that anyone over the age 13 ask their parents for permission before sending any information to anyone over the internet. Popover’s Site and Service are not intended for users under the age 13. We do not knowingly collect information from children under the age of 13. Popover will not knowingly allow any user under age 13 to register or use our Service. If Popover knows that any user under the age of 13 has registered with us or that we have collected information from children under the age 13, Popover will take steps to delete that information as quickly as possible.

CALIFORNIA USERS
Popover does share personal information with third parties for marketing purposes unless you have given us permission to do so by “opting in” to receive that information. If you do not opt in, Popover will not use your personal information for use in marketing by third parties.
